DevOps Institute Online Learning Terms & Conditions
Following are the Online Learning Terms and Conditions agreement that is presented to all candidates during the online learning registration process. During online learning registration candidates must acknowledge and agree to the Online Learning Terms and Conditions mentioned in the document.
THESE TERMS ARE SUBJECT TO CHANGE FROM TIME TO TIME IN DEVOPS INSTITUTE’S SOLE DISCRETION. IT IS YOUR RESPONSIBILITY TO REVIEW THESE TERMS CAREFULLY AS YOU MUST COMPLY WITH THE MOST CURRENT VERSION OF THE AGREEMENT.
The following are the terms and conditions for use of the Online Learning courses described herein (the “Product”) between DevOps Institute, Inc. and you (either an individual or a legal entity that you represent as an authorized employee or agent) (“You”). Please read them carefully. The Products are offered to each User subject to such User’s acceptance of all of these Terms & Conditions and all other applicable terms and conditions, operating rules, policies and procedures that are communicated from time to time on or through the Platform.
A User should read the Terms & Conditions carefully before registering an account or purchasing the Online Course or any Content or using any Services. By browsing, accessing or using any part of the Platform, including the registration by a Registered User to open an account (a “User Account”), a User agrees to be bound by these Terms & Conditions. If a User disagrees with or cannot follow these Terms & Conditions (in part or in whole), then such User should not browse or access the Platform, purchase any Products or register to create a User Account.
1. ONLINE COURSE PROVIDER
DevOps Institute works to advance the human elements of DevOps. We create a safe and interactive environment where members can network, gain knowledge, grow their careers, support enterprise transformation, and celebrate professional achievements.
We are not just an information source; we connect and enable the global Member community to drive human transformation in the digital age.
2. REGISTRATION AND SECURITY
To register for the Product, You must complete the registration process by providing DevOps Institute with current, complete and accurate information as prompted by the registration form, including your name, e-mail address, username and password. We develop, distribute and maintain the Products and will also provide you with log in details. We will also manage your access to the Products and provide support to you, where necessary.
You shall not copy, modify, transmit, distribute or in any way exploit the Products or any other copyrighted materials provided other than for your individual training. Any other purpose is expressly prohibited under these terms. You shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit the Products or any other copyrighted materials.
3. GRANT OF LICENCE
In consideration of your payment, we hereby grant you an individual licence to use the purchased Online Learning course (“the Product”). This licence is limited, revocable, non-exclusive, non-sublicensable and non-transferable, and is subject to the rights and obligations granted under these Terms. This licence is personal to you and cannot be shared or exchanged with others.
4. ACCESS TO MATERIAL
The starting date of your access to the Product(s) is deemed to be the date of purchase. It is the responsibility of the student to ensure that all course content has been completed within the allocated time period. If you do not think this will be possible, then extensions of time may be available for purchase at an additional cost.
We will take all commercially reasonable steps to provide you with uninterrupted access to the Products. However, your access may be restricted from time to time for reasons beyond our control. Such reasons include force majeure events, power outages and actions from computer hackers and others acting outside the law. Your access may also be interrupted due to software issues, server downtime, increased Internet traffic, programming errors, regular maintenance by the platform provider and other related reasons. Where this is the case, we will take commercially reasonable steps to work with the platform provider to restore your full access within a reasonable period of time.
Our joint aim is to provide courses and materials of the highest quality. As such, improvements or changes to the Products or any other materials may occur at any time without prior notification in order to ensure that they are up to date and accurate.
5. PRICING AND PAYMENT
We use third-party payment providers such as Stripe or PayPal. Payment for the Products must be made at the point of purchase.
You agree to provide payment for the Products in the stipulated currency and you will be liable to pay any relevant conversion charges. Please note that we must receive your payment in full before providing you with access to the Products.
Your payment includes the licensing of the Products for a limited period of time that is appropriate for the online learning content. We are unable to provide a refund once you have purchased the online learning course or if you fail to complete the content within the allocated time.
We reserve our right to review and change the pricing of any of our products. This will not affect products that have already been purchased.
You will not (and will not allow any third party to) attempt to copy, distribute, record or reverse engineer any Learning Videos or Documentation supplied by DevOps Institute or stored on the Online Learning platform.
DevOps Institute reserves the right to monitor IP addresses that are used to access the Online Courses and Materials and, if a student is considered to be in contravention of the access rules (such as sharing an individual license), we may terminate a student’s access to the Online Course and the Course Material immediately. In such circumstances, no refund will be given.
7. THIRD PARTY CONTENT
Through the Products, you may have the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. DevOps Institute cannot guarantee that such third party content, in the Products or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. Our website disclaims any responsibility or liability related to your access or use of, or inability to access and use, such third party content.
8. COPYRIGHT AND TRADEMARK POLICY
At all times, DevOps Institute remains the owner of the intellectual property in the Online Courses and the Course Materials. Other than as specified, no Online Course and/or Course Materials, nor any part of it may be reproduced, stored in a retrieval system or transmitted in any form or by any means without the prior written permission of DevOps Institute. DevOps Institute respects the intellectual property rights of our users, Content Providers, and other third parties and expects our users to do the same when using the Products.
9. MODIFYING AND TERMINATING OUR SERVICES
We are constantly changing and improving our Products. We may add or remove functions, features, or requirements, and we may suspend or stop access to part of our Products altogether. DevOps Institute may terminate your use of any Product for any reason. We may not be able to deliver the Products to certain regions or countries for various reasons, including due to applicable export control requirements or internet access limitations and restrictions from governments. DevOps Institute, its Content Providers and instructors, its contributors, sponsors, and other business partners, and their employees, contractors, and other agents shall not have any liability to you for any such action.
10. CANCELLATION POLICY
DevOps Institute will not issue refunds should you choose to cancel your registration or purchase of an Online Learning course. If you still wish to cancel your registration, please contact us via email at [email protected] so we may remove your registration from the platform. It is your responsibility to ensure that you meet the system requirements, including compatible hardware, software, telecommunications equipment and Internet service, prior to purchasing any content. We are unable to provide refunds where your access to the Products is inhibited due to insufficient system requirements. We may restrict or cancel your access to the Products if you breach these terms, including without limitation:
- A failure to make any payment due to us; or
- Failure to provide accurate information that is necessary for us to provide the Products to you; or
- If a student is considered to be in contravention of the access rules (such as sharing an individual license)
In these circumstances, we may inform you in writing that your access to the Products will be restricted or canceled.
The Products and all included content are provided on an “as is” basis without warranty of any kind, whether express or implied. The Online Learning parties specifically disclaim any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. The Online Learning parties further disclaim any and all liability related to your access or use of the Products or any related content. You acknowledge and agree that any access to or use of the Products or such content is at your own risk.
12. LIMITATION OF LIABILITY
You agree to indemnify, defend, and hold harmless DevOps Institute from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party related to: (a) your use or attempted use of the Products in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
14. GOVERNING LAW AND JURISDICTION
You agree that any dispute related to these Terms will be governed by the laws of the State of Florida, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of an exclusive venue in the federal and state courts located in and serving Boca Raton, Florida as the legal forum for any such dispute.
